TERMS AND CONDITIONS
The order or purchase of any Ultimate Exotics product or service indicates that you have read and accepted the below stated Terms and Conditions. Ultimate Exotics makes an assortment of information and services available through our website collectively, subject to these Terms and Conditions. There may be a variety of information and services offered through our website that have separate registration procedures, terms and conditions, terms of service, user agreements, or similar legal agreements. Also, Ultimate Exotics may offer other services from time to time that are governed by the terms of service of the respective service partners. Information and products or services available at Ultimate Exotics may not be available in all countries. If you choose to purchase Ultimate Exotics products from outside of Canada, you do so on your own initiative and are accountable for accordance with all laws (local or state), import and export restrictions, or general regulations.
A purchase will be validated once received by postal mail or email together with the Ultimate Exotics reservation form duly completed and payment of 100% of the purchase amount including and taxes applicable by credit card, debit card or cheque.
Gift experiences delivered by Ultimate Exotics will have an expiration date of 2 years from date of purchase. Dollar value gift certificates do not expire and can be applicable towards any experience or can be transferred to another party providing all requirements are met. Season Passes are only valid for the season purchased on their terms and conditions.
Should you need to reschedule your experience, there is a 2 week rebooking policy to transfer free of charge before your booked experience date. Should you reschedule or cancel less than 2 weeks of the experience your voucher may become void as we are reserving the exotics for you. Changes may be made to Ultimate Exotics products or services, at any time, without notice.
MONEY BACK GUARANTEE
All experience vouchers are backed by a 14 day money back guarantee. This must be any experience which has not yet been redeemed on a booked date. Any refund given must be requested in writing on email from the original purchase and will be provided on the original payment credit card. Once this has been redeemed there are no refunds given. After 14 days of original purchase date, no refunds are applicable and may not be given. After this period of 14 days, vouchers are able to be transferable. If you cannot make a booked event date for any circumstance, you can transfer your experience to another friend, family member or individual to take your place. If you do not show up for a booked event/experience (no show) your voucher/booking will become void. Season Pass sales are final and not applicable for refunds or transferable.
ALL DRIVING EXPERIENCES BUT NOT LIMITED TO GROUP/CORPORATE EVENTS CUSTOM TAILORED EVENTS TERMS AND CONDITIONS
All drivers participating on any experience or drive provided by Ultimate Exotics must be at least 21 years of age and have a valid Driver’s license. All drivers participating in the driving program will be required to provide a valid Driver’s License or equivalent on date of experience which will be used for identification purposes as well as proof of general driving skills needed to operate vehicles during your experience. Ability to operate a manual transmission is not required for participation.
Participants scheduled to a ride-along under the age of 18 must be accompanied by an adult who must give written consent.
Passenger only participants are required to pay equal price as all drivers are rotated equally. If you have a passenger joining with you not driving, you will get double seat time behind the wheel. Passenger only requirements are 8 years of age or older.
All participants will be required to sign an Adult Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement at the event. If you do not meet the requirements for age or have the required driver’s license you will not be able to drive in the experience and not be applicable for reschedule or refund.
RESERVATION & BOOKING OF EVENTS
Reservations are required for all driving experiences and events: space is limited and is filled on a first come first serve basis. Reservations are not cancellable or refundable. In the event you cancel your reservation or do not show up for your scheduled event, your order and payment will not be refunded. This reservation is transferable to another party meeting the qualification requirements with consent from the original recipient.
Dates are subject to change without notice. Ultimate Exotics is not responsible for any travel expenses incurred by changes beyond our control. Ultimate Exotics reserves the right to postpone or to modify the experience or substitute cars due to maintenance. Confirmation of the reservation will be sent by email prior to the date of the event.
The receiver of the gift certificate or the package experience will subsequently choose the date of the event among available dates. The holder of the gift certificate reserves the right to reschedule up until 14 days prior to the event date. Once within 14 days of the event, no changes can be made without incurring additional fees or loss of voucher.
RAIN-OUT & FORCE MAJEURE POLICY
Ultimate Exotics reserves the right to cancel an event for bad or unsafe weather or in case of force majeure. The definition of bad weather or unsafe driving conditions shall be at the sole discretion of Ultimate Exotics, but is generally defined as ice, snow, freezing rain, wind and may include heavy rains during the event. In case of any force majeure event leading to the unavailability of an experience or a car, Ultimate Exotics reserves the right to reschedule the event or to replace it by an equivalent or superior event.
In the event of rescheduling permitted by us, Ultimate Exotics will contact you and confirm the re scheduled date options, usually following a reschedule. In the case of event refusal of any of the newly proposed events, your event date and experience will be considered terminated. A refund will not be issued due to rainouts or cases of force majeure. In case of inclement conditions occurring after the event has begun, the latter may be temporarily interrupted and moved back later on the same day. In case your event cannot be fully completed due to lack of time or continuous adverse conditions, you will not be able to claim for the uncompleted portion of your experience. Any delay or timing extension of your experience due to a rain out or force majeure conditions will not allow for any dispute, discount or rebate.
LOW PARTICIPATION
With our experiences operating 7 months per year, 7 days a week, we occasionally need to reschedule experiences due to low participation. We open our calendar as long as possible and do our best to accommodate bookings. If you booked an experience, we reserve the right to reschedule due to low participation if your experience occupancy is below 50%.
PRICE & PAYMENT CONDITIONS
Prices mentioned on our website, our brochures and any of our commercial supports as listed are before any applicable tax. Ultimate Exotics reserves the right to modify its prices without notice. Full payment by credit card must be received to validate the reservation. Cash & Debit Payments are available at our Head Office in Stoney Creek.
PRIVACY POLICY
By participating in any or all Ultimate Exotics experiences, you have granted the right to use your name, likeness, voice, photographs, and video of all clients taken by Ultimate Exotics, authorized agents, and/or any media groups during experiences. This includes, but is not limited to: television, radio, film, social media and all other media mediums that may be used by Ultimate Exotics for business use.
LIABILITY & CODE OF CONDUCT
Ultimate Exotics will assume responsibility for any damages that might occur to the cars on an experience such as windshield or tire damage except in cases of willful or reckless conduct or gross negligence. All other damages and expenses are the responsibility of the participant per the Event Adult Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement form that all participants are required to complete prior to program participation. All exotic car rental damage is fully responsible by the renter and subject to the terms and conditions signed and agreed upon on the rental agreement.
All participants must follow safety rules dictated by Ultimate Exotics and its staff. Ultimate Exotics reserves the right to cancel or interrupt the experience of a participant if all safety conditions are not met.
Alcohol and controlled substances are prohibited for all participants to a driving experience. Ultimate Exotics reserves the right to perform alcohol and controlled substances tests randomly or in case of reasonable suspicion.
